This Liability Waiver and Release of Claims ("Waiver") is entered into by the undersigned dog owner or authorized handler ("Client") in connection with mobile dog gym services ("Services") provided by Zoomies LLC ("Zoomies"), including treadmill conditioning, agility activities, and enrichment sessions performed at Client's home or another location arranged with Zoomies.
Client understands that physical activity involving dogs carries inherent risks, including but not limited to falls, muscle strain, cardiac events, bites, scratches, and aggravation of pre-existing conditions. Client voluntarily assumes all such risks on behalf of themselves, their dog, and any household members or bystanders present during the Services.
Client releases, waives, and discharges Zoomies, its owners, trainers, employees, and contractors from any and all liability, claims, demands, or causes of action arising out of or related to any loss, damage, injury, or death that may occur during or as a result of the Services, except where caused by Zoomies' gross negligence or willful misconduct.
Client agrees to indemnify and hold harmless Zoomies from any claims, damages, or expenses (including reasonable attorney's fees) arising from Client's dog causing injury to any person or damage to any property during the Services.
Client represents that their dog is in good health, is current on all required vaccinations (including rabies, DHPP, and bordetella), is free of contagious illness, and has no known aggressive history that has not been disclosed to Zoomies in writing prior to the session.
Zoomies reserves the right to pause, modify, or decline a session at its sole discretion if a trainer determines the dog's behavior, health, or the session environment poses a safety risk. No refund obligation arises solely from such a decision.
Client grants Zoomies permission to photograph or video their dog during sessions and to use such media for marketing purposes, unless Client opts out in writing prior to the session.
If Client cannot be reached during a session and a trainer reasonably believes the dog needs immediate veterinary attention, Zoomies may arrange emergency veterinary care on Client's behalf. Client agrees to reimburse Zoomies for any veterinary fees advanced and authorizes treatment necessary to protect the dog's health and safety.
This Waiver is governed by the laws of the Commonwealth of Virginia. If any provision is found unenforceable, the remaining provisions remain in full effect.
